Well, the RIAA might still be chasing guilty teenagers around, but now it looks like some people are fighting back. Frankly, while I applaud the spirit and initiative being exhibited here, as a practical matter I am not convinced that a court will find the necessary predicate acts to give rise to a valid civil RICO claim: there is no illegal act; there is no fraudulent action on the part of the recording industry; and its ludicrous to suggest that a party, after filing suit, can not seek to then settle the litigation in a fashion designed to both minimize litigating expenses and maximize recoupment of fees and penalties.
Still, if they have a theory not explored in the article, then all the more power to them.
